| 1. | Promotion open to residents of UK, Republic of Ireland, the Isle of Man and Channel Islands aged 18 or over, excluding employees of the Promoter, their families, agents and anyone associated with the competition. |
| 2. | By entering this promotion, entrants agree to be bound by these terms and conditions of entry. Entries which are not in accordance with these conditions of entry will not be valid and the Promoter reserves the right in its discretion, to disqualify such entries at any time during the promotion. |
| 3. | A maximum of four entries will be accepted per person. |
| 4. | No purchase necessary. To enter complete your personal contact details on the on-line form, upload a photo of your cat and tell us in 140 characters or less why you think it would recommend Whiskas to its feline friends. |
| 5. | Entries must be received by this website by midnight on 30 October 2009. |
| 6. | Entries must be the original work of the entrant. |
| 7. | Photographs should contain images of a cat or cats and background objects only and should not feature any people. Material included in the entry must not be rude, offensive, insulting, defamatory or objectionable and should not depict any cruelty to animals. Any such entries will automatically be disqualified. Disqualification of any entry shall be at the discretion of the Promoter. |
| 8. | Any costs associated with taking part in the competition shall be the responsibility of the entrant. |
| 9. | One winner will receive a supply of Whiskas for the life of their cat. The prize consists of the quantity of Whiskas cat food recommended for consumption by one medium-sized adult cat on a daily basis, for the remainder of the cat's life (up to a maximum of 16 years). |
| 10. | One runner-up from each of the following 13 regions will win a supply of Whiskas for 1 year: North West, North East, Yorkshire & Humberside, East Midlands, West Midlands, East of England, South West, South East, London, Wales, Scotland, Northern Ireland IoM & Channel Isles and Republic of Ireland. The location of residence selected by each entrant from the drop-down list on the online form will determine their regional classification. |
| 11. | Each of the winners of the supply of Whiskas for 1 year will receive the quantity of Whiskas cat food recommended for consumption by one medium-sized adult cat on a daily basis, for 12 months. |
| 12. | The winner and runners-up may choose any products from the Whiskas core wet and dry range. Prizes will be delivered in 6-monthly instalments with the first delivery being made within 28 days of that winner confirming their choice of products. The delivery address for a prize must be an address in the UK, Channel Isles, Isle of Man or ROI. |
| 13. | All valid entries will be assessed by a panel of judges by 30 November 2009 and the winners will be notified in writing by 30 December 2009. To claim their prize, winners and runners up should follow the instructions included with their notification (including nominating which products from the Whiskas core wet and dry range they would like to receive). |
| 14. | In determining the winner and 13 runners-up the judges will consider the following criteria: (a) the creativity and originality of the entry; (b) the cat's appreciation of Whiskas; (c) the lengths the cat will go to for their favourite food, including but not limited to dedication, persistence, cuteness and mischief; and (d) the number of votes an entry receives in any voting conducted on the Whiskas and Facebook websites. It is not compulsory that the photo depicts the story; however photos will be taken into consideration in determining the winner. |
| 15. | The judges' decision is final and no correspondence will be entered into. |
| 16. | Users of the Whiskas and Facebook websites can vote for their favourite photograph and all votes will be recorded. Users can only vote for each cat once per day per site. There is no limit on the number of cats users can vote for. |
| 17. | The number of votes recorded against each entry will be used as one of four criteria by the judges in determining the winning entries. The number of recorded votes alone will not determine the outcome of the competition. |
| 18. | In the event that the Promoter is unable to make contact with the winner or runner up within 28 days of the judging, the Promoter reserves the right to select an alternative winner and/or runners-up. |
| 19. | The winner and runners-up consent to their photograph and winning story being published on Whiskas 12 Pouch Packs that will appear on-shelf in the UK for approximately three months. The winner and runners-up may be required to assign all intellectual property to their entry to the Promoter in accordance with condition 25 below. At the Promoter's discretion, the winner's name may be used in association with the promotion or on or in connection with such packaging. |
| 20. | The Promoter reserves the right: (1) not to use a winning entry (or to use an entry of a runner-up) on pack, where the winning entry is not, in the judges' opinion, appropriate or where the entry cannot be successfully represented on-pack; and (2) to modify the winning entry as necessary to facilitate commercial printing and branding requirements and to recreate the look and feel of the promotion, without consultation with the winner. |
| 21. | The winning entry may need to be altered by the Promoter as photographs cannot always be accurately reproduced in the production process. Design and production times may affect the period that the winner's entry appears on packaging. |
| 22. | The winners and runners up can forfeit their prize at any time by writing to Win Whiskas for life promotion, Mars Petcare UK Limited, Freeby Lane, Waltham on the Wolds, Melton Mowbray, Leics LE14 4RT. Winners may not transfer their award to any other person without written permission from the Promoter. |
| 23. | Details of the winner and runners-up (names and counties only) will be available by sending a stamped, self addressed envelope to 'Win Whiskas for life Promotion Winners', BD Network, Tea Building, 56 Shoreditch High Street, London, E1 6PQ after 30 December 2009 |
| 24. | All prizes are as stated, are non-transferable and there are no cash alternatives. |
| 25. | By entering the competition and confirming online that they have agreed to these conditions of entry, entrants agree that: (a) their entry is not copied from anyone else's work and that their entry is their sole and original work; (b) that their entry has not previously been published, printed, marketed or reproduced by any third parties and is not the subject of any trade mark or entry right application or registration; (c) their entry can be featured on the Whiskas, Facebook, Flickr and other third party websites, and in any other advertising and marketing media at the promoter's discretion; (d) if they are chosen as a competition winner or runner-up their entry (including photograph) will become the property of the promoter and they hereby waive all moral and similar rights in their entry to the fullest extent possible; (e) if they are chosen as a competition winner, they will have no rights in their entry whatsoever and the Promoter will be free to make use of the entry in any manner it chooses (although the Promoter will not be obliged to make any use of the entry whatsoever), in whatever media (whether now known or invented in the future) throughout the world and that they will have no claim against the Promoter for any such use and will not be entitled to any income or compensation in connection with the Promoter's use of the design; (f) they will provide all consents, assignments and waivers (written or otherwise) requested by the Promoter to give legal effect to the foregoing and also provide the consent of a parent or guardian where such consent is required by law; and (g) failure to provide the relevant consents, assignments or waivers requested by the Promoter will disqualify the competition winner, and a different competition winner or runner-up will be chosen in their place. |
| 26. | The Promoter is not responsible for any entries or votes that fail to be submitted correctly due to any technical error on this Website or any third party site. Proof of logging in and submitting your entry is not proof of receipt of an entry by the Promoter. |
| 27. | The Promoter is not responsible for any: (a) telephone, computer, hardware, software, programming or network malfunction or error; (b) communication disruption or other forces beyond the reasonable control of the Promoter, including disruption related to internet traffic, virus, bug, or non-authorised intervention; or (c) damage caused by computer virus or otherwise resulting to any computer from entrants' access of the website. If such malfunction, error, disruption, or damage occurs, impairs the administration, security, fairness, integrity, or proper participation in the competition, the Promoter may, in its sole discretion, suspend or terminate the competition by posting a notice on the Website without any liability to participants. Entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method are void. Entries will be deemed made by the authorised account holder of the e-mail address submitted at the time of entry. The authorised account holder is the natural person who is assigned to the e-mail address by an internet access provider, on-line service provider, or other organisation that is responsible for assigning e-mail addresses or the domain associated with the e-mail address. |
| 28. | The winner and regional runners up agree to take part in any post publicity for the competition that may be organised by the Promoter and in any news media activities surrounding the competition. |
| 29. | Except where entrants have indicated on the on-line entry form that they are happy to be contacted for marketing purposes, entrants' personal information will be used to administer the competition only and not for future marketing or other purposes. |
| 30. | The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this competition at any time with no liability to any entrant or any third party. |
| 31. | This promotion and these terms and conditions of entry are governed by English Law and the courts of England shall have exclusive jurisdiction over any dispute arising out of or in connection with this promotion. |
